Orzeł Biały S.A. ended the first half of 2009 with sales revenue at PLN 83.4 million. The Company recorded in this period a net loss of PLN 1.4 million. In the first half of the year, the impairment losses on assets in the total amount of PLN 6.3 million has the decisive impact on the operating result, in connection with the initiated proceedings before the Court of Competition and Consumer Protection. Disregarding such one-off events, the operating profit of the Group would have been positive and amounted to PLN 4.2 million, says Zbigniew Rybakiewicz, President of the Management Board of Orzeł Biały S.A.

The Management Board of Orzeł Biały S.A. headquartered in Bytom announces that on 19 March, 2009 it filed an appeal against the Decision of the President of the Office of Competition and Consumer Protection UOKiK against the merger of Orzeł Biały S.A. and Baterpol Sp. z o.o.

Today, the company authorities of Orzeł Biały S.A. received the decision of the President of the Office of Competition and Consumer Protection UOKiK regarding the acquisition of Baterpol. The Office President did not approve the merger of the two entities.

The Management Board of Orzeł Biały S.A. hereby notifies that the edition of Gazeta Giełdy Parkiet dated 6 March, 2009 in the article entitled „OCCP prohibited the acquisition of Baterpol by Orzeł Biały” featured a false piece of information as if allegedly the President of the management Board Zbigniew Rybakiewicz announced the collaboration of companies of Orzeł Biały S.A. and Baterpol Sp. z o.o.

Orzeł Biały S.A. announced the completion of negotiations for the acquisition of Baterpol. Yesterday, the preliminary agreement was signed for the sale of 100% stake in Baterpol in favour of Orzeł Biały. The agreement was concluded between Polski Cynk sp. z o.o. and Orzeł Biały S.A., with the participation of Impexmetal S.A., which is the dominant entity of Polski Cynk.
